Federal PFAS Regulations: Navigating the Path to Compliance

EPA National Primary Drinking Water Regulation 

Enacted on April 10, 2024, this law sets the first federally enforceable limits for six PFAS compounds in drinking water: PFOA, PFOS, PFBS, PFNA, PFHxS, and GenX (HFPO-DA). The regulation provides a framework for states to develop strategies for PFAS reduction in drinking water, with some states, like Minnesota, already enacting their own PFAS regulations.

TSCA Section 8(a)(7) PFAS Reporting and Recordkeeping Rule 

This rule requires businesses that manufactured, imported, or used PFAS between January 1, 2011, and December 31, 2022, to submit a one-time comprehensive report to the EPA. The EPA has delayed the reporting period from November 2024 to July 2025 due to resource constraints. Most reporters will be required to submit the required information by January 11, 2026, while small businesses reporting data solely on importing PFAS contained in articles will have until July 11, 2026.

The rule requires due diligence from companies in determining whether they need to report. If a company does need to submit a report, it must be based on the best-available information regarding PFAS-containing product use since 2011.

Addition of PFAS to the Toxics Release Inventory (TRI) 

The EPA has also proposed adding 16 PFAS and 15 PFAS categories to the Toxics Release Inventory (TRI), which is a list of toxic chemicals subject to reporting under the Emergency Planning and Community Right-to-Know Act (EPCRA) and the Pollution Prevention Act (PPA). This development could be significant for businesses that may need to report their PFAS releases and waste management activities.
